Veritas Department of Navy (DON) Enterprise Software License (ESL) Agreement

In the spirit of the Federal Acquisition Streamlining Act and the Defense Federal Acquisition Regulation Supplement (DFARS) Section 208.74, the Space and Naval Warfare Systems Center Pacific (SPAWARSYSCEN PACIFIC) Contracting Office on behalf of the U.S. Department of Navy (DON) and Carahsoft have entered into a Blanket Purchase Agreement. All orders placed against this BPA are subject to the terms and conditions of the FSS Contract.

This DON ESL Agreement will continue to provide a contract vehicle to purchase new Veritas Licenses, software maintenance, subscriptions, proprietary appliances, and training, as well as maintenance for all Veritas license previously purchased and still in use.

This is a mandatory use BPA: The use of Department of the Navy (DON) Enterprise Software Licensing (ESL) Agreements is mandated per the 22 February 2012, DON Chief Information Officer (CIO)/Assistant Secretary of the Navy (ASN) Research, Development, & Acquisition (RDA)/ASN Financial Management & Comptroller (FMC) memorandum to achieve maximum cost savings.

1. Department of Navy (DON) Components:

This BPA is open for ordering by the DON for use by the DON, on a world-wide basis. Pursuant to Joint Publication 1-02, Department of Defense Dictionary of Military and Associated Terms, as amended through 15 March 2014, the DON is defined as the executive part of the Department of the Navy at the seat of Government; the headquarters, United States Marine Corps; the entire operating forces of the United States Navy and of the United States Marine Corps, including the Reserve Component of such forces; all field activities, headquarters, forces, bases, installations, activities, and functions under the control or supervision of the Secretary of the Navy; and the United States Coast Guard when operating as a part of the Navy pursuant to law. This definition shall apply whenever the term “Department of Navy,” “DON,” and/or “DON Activity” are used in this BPA.

2. GSA / Other Ordering Organizations:

GSA or other applicable U.S. Government ordering organizations/agencies are authorized to place Orders under this BPA on behalf of and for the benefit of the DON as long as they specify the Customer number under which the order will be recorded for sustainment purposes in the follow-on agreement.

3.Contractors and Integrators:

Contractors and Integrators performing work for the DON may order on behalf of and for the benefit of the DON if authorized by their cognizant Contracting Officer in accordance with the requirements of Federal Acquisition Regulation (FAR) 51, Use of Government Sources by Contractors, and/or Defense Federal Acquisition Regulation Supplement (DFARS) 251, Use of Government Sources by Contractors, as appropriate. Government contract should specify licenses as Contractor Acquired Property (CAP) and provide instructions for delivery of licenses to Government at contract completion. Cognizant contracting officer shall designate the Command, Agency, or its Agency Affiliate to receive CAP at contract completion for which the FAR 51 Letter of Authorization was executed.
